1. Introduction

These Affiliate Program Terms and Conditions (“Agreement”) govern participation in the Eskaykay Electronics Affiliate Program (“Program”). By registering as an affiliate or participating in the Program, you agree to be legally bound by these terms.

Eskaykay Electronics reserves the right to update or modify this Agreement at any time. Continued participation after changes constitutes acceptance of the revised terms.

2. Eligibility & Registration

• You must be at least 18 years old
• Affiliate registration is subject to approval
• Eskaykay Electronics may accept or reject applications at its discretion
• Only one affiliate account per person or business is allowed

3. Affiliate Categories

Eskaykay Electronics may operate multiple referral categories, including:

• Marketers (Affiliates):
  Approved promoters eligible for standard or higher commission rates
• Customer Referrers:
  Customers who may earn limited referral bonuses

Commission rates may vary by product, category, or promotional campaign.

4. Commission Structure

• Commissions may be percentage-based or fixed
• Commissions are earned only when an order is marked “Completed”
• Commission rates are subject to change without prior notice
• Only one affiliate commission is awarded per order

5. Commission Eligibility & Restrictions

Commissions will NOT be paid for:

• Self-referrals or personal purchases
• Fraudulent or fake transactions
• Cancelled, refunded, reversed, or disputed orders
• Orders generated through misleading, deceptive, or unethical marketing
• Any attempt to manipulate tracking or commissions

Unpaid commissions linked to refunds or fraud will be rejected or forfeited.

6. Tracking & Cookies

• Affiliate tracking is cookie-based
• Cookie duration is determined by platform settings
• Last affiliate click receives credit
• Eskaykay Electronics is not responsible for tracking loss due to:
  • Cookie deletion
  • Browser privacy settings
  • Ad blockers or device changes

7. Payments & Withdrawals

• Commissions become payable only after successful order completion
• Payments are processed manually
• Approved payment methods include bank transfer or other methods set by Eskaykay Electronics
• Minimum payout thresholds apply
• Eskaykay Electronics reserves the right to delay payments for verification or fraud review

8. Promotional Rules

Affiliates must NOT:

• Misrepresent product pricing, performance, or availability
• Make false guarantees or claims
• Impersonate Eskaykay Electronics
• Use company branding or logos without permission
• Engage in spam marketing (SMS, WhatsApp, email, or social media spam)

9. Termination

Eskaykay Electronics may suspend or terminate any affiliate account for:

• Breach of these terms
• Fraud or abuse
• Inactivity
• Actions that harm the brand or reputation

Upon termination, all unpaid commissions connected to violations will be forfeited.

10. Relationship of Parties

Affiliates are independent contractors, not employees, partners, or agents of Eskaykay Electronics. Affiliates have no authority to bind or represent the company.

11. Limitation of Liability

Eskaykay Electronics shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program.

12. Governing Law

This Agreement shall be governed by and interpreted under the laws of the Federal Republic of Nigeria.
